Terms of Service

These Terms of Service ("Terms") govern your access to and use of blueborrow.com (the "Site") and the matching and referral service we provide (the "Service"). The Site is operated by BlueBorrow ("BlueBorrow," "we," "us," or "our"). By using the Site or submitting our form, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.

1. What BlueBorrow is — and is not

We are a matching service, not a lender. BlueBorrow does not make loans, issue credit, take loan applications, or make credit decisions. We collect the information you choose to submit and refer it to third-party loan specialists, lenders, lending networks, and related providers ("Partners") who may contact you about loan options. We do not guarantee that you will be matched, contacted, offered a loan, or approved, and we make no representation about the rates, amounts, fees, or terms any Partner may offer. All loan decisions and terms are made solely by the Partner or lender, subject to their own requirements and applicable law.

BlueBorrow is not a credit reporting agency, does not provide credit repair services, and nothing on the Site is financial, legal, or tax advice. The "estimated credit rating" you select is your own self-assessment; we do not pull your credit. Partners you are matched with may perform credit inquiries under their own terms, which they will disclose to you.

2. Eligibility

The Service is available only to individuals who are at least 18 years old, reside in the United States, and have the legal capacity to enter into contracts. By submitting the form, you represent that you meet these requirements and that all information you submit is accurate, current, about yourself, and submitted with your authority.

By submitting our form, you expressly acknowledge, agree, and consent to the following:

BlueBorrow will share — and may sell, as defined under applicable state privacy laws — the information you submit with third-party Partners so they can evaluate your request and contact you about loan options and related products or services, as described in our Privacy Policy;
BlueBorrow and its Partners may contact you at the telephone number and email address you provide — by live calls, SMS text messages, and email, including (where you have checked the consent box) calls and texts placed using automated technology or prerecorded messages;
Your consent to receive calls and texts is not a condition of any purchase, loan, or service. Message frequency varies; message and data rates may apply. You may opt out of texts at any time by replying STOP, and may revoke consent by contacting us at support@blueborrow.com;
BlueBorrow may receive compensation from Partners in connection with your referral (see Section 4).

4. How we make money (advertising disclosure)

The Service is free to you. BlueBorrow is compensated by Partners when we refer consumers to them. This compensation may influence which Partners receive your information. We are an independent referral service and are not your agent, broker, or fiduciary.

5. Acceptable use

You agree not to: submit false, misleading, or third-party information without authority; use the Site for any unlawful purpose; interfere with the Site's operation or security; scrape, harvest, or copy content or data; or use automated means to submit forms. We may block, throttle, or refuse service at our discretion.

6. Intellectual property

The Site and its content (text, design, graphics, logos, and code) are owned by or licensed to BlueBorrow and protected by intellectual-property laws. You may use the Site for personal, non-commercial purposes only; no other rights are granted.

7. Third-party services and links

Once you are connected with a Partner, your relationship — including any application, loan agreement, or services — is solely between you and that Partner, governed by their terms and privacy policy. We are not responsible for the acts, omissions, products, services, or policies of any Partner or other third party.

8. Disclaimers

THE SITE AND SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT YOU WILL BE MATCHED WITH A PARTNER OR RECEIVE ANY LOAN OR PARTICULAR TERMS.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLUEBORROW AND ITS OWNERS, OPERATORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless BlueBorrow from claims, damages, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Site, to the extent permitted by law.

11. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Except where prohibited, any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by a recognized arbitration provider under its consumer rules, and you and BlueBorrow each waive the right to a jury trial and to participate in a class action. Either party may instead bring an individual claim in small-claims court. You may opt out of this arbitration provision within 30 days of first accepting these Terms by emailing support@blueborrow.com with the subject "Arbitration Opt-Out."

12. Changes to these Terms

We may update these Terms from time to time. The "Effective date" above reflects the latest revision. Changes apply prospectively; your continued use of the Site after changes take effect constitutes acceptance.
